New general de minimis regulation published

The European Commission has recently published the new general de minimis Regulation (Commission Regulation (EU) 2023/2831 (OJ L, 2023/2831, 15.12.2023) of 13 December 2023 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union to de minimis aid(link is external)) which enters into force on 1 January 2024.

There are two important changes for Interreg programmes granting de minimis aid:

  1. The threshold of aid not to be exceeded was increased from €200,000 to €300,000 over any period of 3 years, in order to cater for inflation.There is no longer separate threshold for road freight transport.
  2. The introduction of an obligation for Member States to register de minimis aid in a central register set at national or EU level as of 1 January 2026.
